Agreement
Article 1 (Purpose)
The purpose of these Terms and Conditions is to define the rights, obligations, and responsibilities of the online shopping mall "SHUSHU CHERRY" (hereinafter referred to as the "Mall") operated by SHUSHU CHERRY (hereinafter referred to as the "Company") and its users in using the internet-related services (hereinafter referred to as the "Service") provided by the Mall.
Article 2 (Definitions)
① "Mall" refers to a virtual business establishment set up by the Company to trade goods or services (hereinafter referred to as "Goods, etc.") using information and communication facilities.
② "User" refers to members and non-members who access the Mall and use the Services provided by the Mall in accordance with these Terms and Conditions.
③ "Member" refers to a person who has registered as a member of the Mall and can continuously use the Services provided by the Mall.
④ "Non-member" refers to a person who uses the Services provided by the Mall without joining as a member.
Article 3 (Disclosure, Explanation, and Amendment of Terms)
① The "Mall" shall post the contents of these Terms, the company name, representative's name, business address, telephone number, email address, business registration number, mail-order business registration number, and the name of the personal information protection officer at the bottom of the main page so that users can easily identify them. However, the contents of the Terms may be made available through a linked screen.
② Before the user agrees to the Terms, the "Mall" shall clearly notify the user of important information such as order cancellation, shipping, and refund conditions through a separate notice.
③ The "Mall" may amend these Terms within the scope that does not violate relevant laws, such as the 「Act on the Consumer Protection in Electronic Commerce」, 「Act on the Regulation of Terms and Conditions」, 「Framework Act on Electronic Documents and Transactions」, 「Electronic Financial Transactions Act」, 「Digital Signature Act」, 「Act on Promotion of Information and Communications Network Utilization and Information Protection」, 「Act on Door-to-Door Sales」, and 「Framework Act on Consumers」.
④ When the "Mall" amends the Terms, it shall announce the effective date and the reason for the amendment on the main page, along with the current Terms, from 7 days prior to the effective date until the day before. However, in the case of changes disadvantageous to the user, a prior notice period of at least 30 days shall be provided. In this case, the "Mall" shall clearly compare the contents before and after the amendment for the user’s convenience.
⑤ Amended Terms shall apply only to contracts concluded after the effective date. For contracts already concluded, the previous Terms shall remain in effect. However, if a user who has already entered into a contract wishes to apply the amended Terms and sends such intent to the "Mall" within the notice period and receives consent, the amended Terms shall apply.
⑥ Matters not specified in these Terms and the interpretation of these Terms shall be governed by the 「Act on the Consumer Protection in Electronic Commerce」, 「Act on the Regulation of Terms and Conditions」, the Consumer Protection Guidelines for Electronic Commerce set by the Fair Trade Commission, and other relevant laws or commercial practices.
Article 4 (Provision and Modification of Services)
① The "Mall" shall perform the following tasks:
Providing information on goods or services and concluding purchase contracts.
Delivery of goods or services for which a purchase contract has been concluded.
Other tasks as determined by the "Mall."
② In the event of goods or services being out of stock or changes in technical specifications, the "Mall" may modify the contents of the goods or services to be provided under future contracts. In such cases, the "Mall" shall immediately announce the modified contents and the date of provision where the current contents are posted.
③ If the "Mall" modifies the contents of the service contracted with the user due to reasons such as out-of-stock goods or changes in technical specifications, it shall immediately notify the user at a contactable address.
④ In the case of the preceding paragraph, the "Mall" shall compensate the user for damages incurred in accordance with relevant laws. However, this shall not apply if the "Mall" proves no intent or negligence, such as in cases of natural disasters, supplier circumstances, or unavoidable reasons in the production process.
Article 5 (Suspension of Service)
① The "Mall" may temporarily suspend the provision of services due to reasons such as system maintenance or communication failure.
② In the event of damages caused by such suspension, the "Mall" shall not be held liable unless there is intent or negligence on the part of the "Mall."
Article 6 (Membership Registration)
① Users apply for membership by filling out the registration form prescribed by the "Mall" and agreeing to these Terms and Conditions.
② The "Mall" shall approve the membership registration unless there are reasons such as the registration of false information or technical obstacles.
③ The membership contract is established at the time the "Mall’s" approval reaches the member.
④ If there are any changes to the information registered at the time of joining, the member must notify the "Mall" of the changes within a reasonable period by modifying their member information or through other means.
Article 7 (Withdrawal of Membership and Loss of Qualifications, etc
① A Member may request to withdraw from the "Mall" at any time, and the "Mall" shall immediately process the membership withdrawal.
② If a Member falls under any of the following reasons, the "Mall" may limit or suspend their membership:
Registration of false information at the time of application for membership.
- Failure to pay the price of goods purchased using the "Mall" or other debts incurred by the Member in connection with the use of the "Mall" on the due date.
- Threatening the order of electronic commerce by interfering with another person's use of the "Mall" or stealing their information.
- Performing an act prohibited by laws or these Terms and Conditions, or contrary to public order and morals, by using the "Mall."
③ After the "Mall" has limited or suspended membership, if the same act is repeated twice or more, or if the reason is not corrected within 30 days, the "Mall" may revoke the membership.
④ If the "Mall" revokes membership, the membership registration shall be canceled. In this case, the Member shall be notified and given an opportunity to explain their position for a period of at least 30 days prior to the cancellation of registration.
Article 8 (Notice to Member
① When the "Mall" gives notice to a Member, it may be sent to the email address previously agreed upon and designated by the Member.
② For notices to an unspecified number of Members, the "Mall" may substitute individual notices by posting on the bulletin board.
Article 9 (Obligations of the "Mall
① The "Mall" shall not engage in acts prohibited by laws and these Terms and Conditions or contrary to public order and morals, and shall do its best to provide goods and services continuously and stably as stipulated by these Terms and Conditions.
② The "Mall" must maintain a security system to protect users' personal information (including credit information) so that users can use internet services safely.
Article 10 (Obligations for Member ID and Password)
① Except in the cases under Article 21, the Member is responsible for the management of their ID and password.
② Members shall not allow their ID and password to be used by a third party.
③ If a Member recognizes that their ID and password have been stolen or are being used by a third party, they must immediately notify the "Mall" and follow the instructions provided by the "Mall."
Article 11 (Obligations of Users)
① Users shall not engage in the following acts:
- Registration of false information when applying for or modifying membership.
- Stealing information from others.
- Changing information posted on the "Mall."
- Transmission or posting of information (such as computer programs) other than the information prescribed by the "Mall."
- Infringement of intellectual property rights, such as copyrights of the "Mall" or other third parties.
- Acts that damage the reputation of the "Mall" or other third parties, or interfere with their business.
- Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the "Mall."
Article 12 (Application for Purchase and Consent to Provide Personal Information, etc.)
① Users apply for purchase on the "Mall" by selecting products, entering required information, and choosing a payment method.
② By applying for a purchase, the user is deemed to have agreed to these Terms and Conditions and the Refund Policy.
Article 13 (Establishment of Contract)
① The "Mall" may not accept a purchase application as described in Article 12 if any of the following applies. However, when entering into a contract with a minor, the "Mall" must notify that the minor or their legal representative may cancel the contract if the consent of the legal representative is not obtained.
- There is false information, an omission, or an error in the application details.
- A minor purchases goods or services prohibited by the Youth Protection Act, such as tobacco or alcohol.
- If accepting the purchase application is deemed to significantly hinder the "Mall's" technical operations.
② The contract is deemed established at the point when the "Mall’s" approval reaches the user in the form of an acknowledgment of receipt as specified in Article 8, Paragraph 1.
③ The "Mall’s" expression of approval must include confirmation of the user’s purchase application, availability of the products for sale, and information regarding the correction or cancellation of the purchase application.
Article 14 (Payment Methods)
① Payment for goods or services purchased at the "Mall" can be made using any of the following available methods. However, the "Mall" shall not collect any additional fees of any name on the price of goods, etc., regardless of the payment method chosen by the user.
- Various bank transfers, such as phone banking, internet banking, and mail banking.
- Various card payments, such as prepaid cards, debit cards, and credit cards.
- Online bank deposit (wire transfer).
- Payment by electronic currency.
- Payment by points issued by the "Mall," such as mileage.
- Payment by gift certificates that the "Mall" has contracted with or recognized.
- Payment by other electronic payment methods.
Article 15 (Acknowledgment of Receipt, Changes, and Cancellation of Purchase Applications)
① The "Mall" shall send an acknowledgment of receipt to the user upon receiving a purchase application.
② If there is any discrepancy in the expression of intent, the user who has received the acknowledgment of receipt may request a change or cancellation of the purchase application immediately after receiving it. The "Mall" must process the request without delay if the user’s request is made before delivery. However, if the payment has already been made, it shall be subject to the provisions regarding the withdrawal of the offer, etc., in Article 19.
Article 16 (Supply of Goods, etc.)
① Unless otherwise agreed upon with the user regarding the timing of supply, the "Mall" shall take necessary measures, such as custom production and packaging, to ensure goods are shipped within 7 days from the date the user places the order. However, if the "Mall" has already received all or part of the payment, it shall take such measures within 3 business days from the date of receiving the payment. In this case, the "Mall" shall take appropriate measures so that the user can track the supply process and status of the goods.
② The "Mall" shall specify the delivery method, the party responsible for delivery costs for each method, and the delivery period for the goods purchased by the user. If the "Mall" exceeds the agreed delivery period, it must compensate the user for damages incurred. However, this shall not apply if the "Mall" proves there was no intent or negligence on its part.
③ For custom-made or pre-order products, the production and delivery schedule specified on the product detail page shall apply.\
Article 17 (Coupons and Points)
① The Company may issue coupons that provide discounts for a certain amount or percentage; the types, details, and issuance of these coupons may be operated and changed according to the Company's policies.
② Coupons can be used within the pre-specified validity period and will expire if the validity period passes or if membership qualifications are lost.
③ The Company may issue points based on its policies when a member purchases products or engages in activities such as writing product reviews within the site. However, if a purchase is canceled or returned, the points issued will be recovered.
④ The Company shall notify members regarding points and coupons through means such as SMS, AlimTalk, FriendTalk, or Kakao Channel messages regarding:
- Granting of sign-up benefits.
- Coupons or points issued by membership tier.
- Information on the validity period of points or coupons, and notification of expiration.
- Appreciation coupons or points granted to members who have made purchases or written reviews.
- Other matters related to the granting, use, expiration, and extinction of points and coupons.
Article 18 (Refund)
If the "Mall" is unable to deliver or provide the goods for which the user has applied, such as due to items being out of stock, it shall immediately notify the user of the reason. If payment has already been received, the "Mall" shall refund the payment or take necessary measures for a refund within 3 business days from the date the payment was received.
Article 19 (Withdrawal of Offer, etc.)
① A user who has entered into a contract with the "Mall" for the purchase of goods, etc., may withdraw the offer within 7 days from the date of receiving the document regarding the contract content in accordance with the 「Act on the Consumer Protection in Electronic Commerce, etc.」 (if the supply of goods is delayed after receiving the document, then from the date the goods are received or the supply begins). However, if there are different provisions in the 「Act on the Consumer Protection in Electronic Commerce, etc.」 regarding the withdrawal of the offer, the provisions of that Act shall prevail.
② In the following cases, a user may not return or exchange goods once they have been delivered:
- If the goods are lost or damaged due to reasons attributable to the user (provided that withdrawal is permitted if the packaging was damaged only to inspect the contents).
- If the value of the goods has significantly decreased due to use or partial consumption by the user.
- If the value of the goods has significantly decreased due to the passage of time to the extent that resale is difficult.
- If the packaging of goods that can be replicated into goods with the same performance is damaged.
③ In the cases of Subparagraphs 2 through 4 of Paragraph 2, the user's withdrawal of the offer shall not be restricted unless the "Mall" has clearly specified such restrictions in an easily accessible location or provided trial products.
④ Notwithstanding the provisions of Paragraphs 1 and 2, if the contents of the goods, etc., differ from the displayed or advertised information or the contract terms, the user may withdraw the offer within 3 months from the date of receipt or within 30 days from the date the user became aware (or could have become aware) of such fact.
Article 20 (Effect of Withdrawal of Offer, etc.)
① The "Mall" shall refund the payment already received within 3 business days upon receiving the returned goods. In such cases, if the "Mall" delays the refund, it shall pay the user delayed interest calculated by multiplying the delay period by the interest rate stipulated in Article 21-2 of the Enforcement Decree of the 「Act on the Consumer Protection in Electronic Commerce, etc.」.
② When refunding the payment, if the user made the payment using credit cards or electronic currency, the "Mall" shall immediately request the relevant payment service provider to suspend or cancel the charge.
③ The cost of returning the goods shall be borne by the user. The "Mall" shall not charge the user any penalty or damages for the withdrawal. However, if the withdrawal is due to the goods differing from the displayed or advertised information or the contract, the "Mall" shall bear the cost of returning the goods.
④ If the user bore the shipping costs when receiving the goods, the "Mall" shall clearly indicate who bears such costs upon withdrawal of the offer so that the user can easily understand.
Article 21 (Protection of Personal Information)
① The "Mall" collects the minimum amount of personal information necessary to provide services when collecting a user's personal information.
② The "Mall" shall not collect information necessary for the fulfillment of a purchase contract in advance at the time of membership registration. However, this does not apply if identification is required prior to a purchase contract for the fulfillment of obligations under relevant laws, in which case only the minimum specific personal information shall be collected.
③ When the "Mall" collects and uses a user’s personal information, it shall notify the user of the purpose and obtain their consent.
④ The "Mall" shall not use the collected personal information for purposes other than the intended purpose. If a new purpose arises or if the information is provided to a third party, the "Mall" shall notify the user and obtain their consent at the time of use or provision. However, exceptions may apply if otherwise provided by relevant laws.
⑤ When the "Mall" is required to obtain a user's consent under Paragraphs 2 and 3, it must specify or notify in advance the identity of the personal information protection officer (department, name, telephone number, and other contact details), the purpose of collection and use, and information regarding provision to third parties (recipient, purpose of provision, and contents of information provided) as stipulated by the 「Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.」. The user may withdraw this consent at any time.
⑥ Users may request to access or correct errors in their personal information held by the "Mall" at any time, and the "Mall" is obligated to take necessary measures without delay. If a user requests a correction, the "Mall" shall not use the relevant personal information until the error is corrected.
⑦ To protect personal information, the "Mall" shall limit the number of persons handling personal information to the minimum and assumes full responsibility for any damages caused to the user due to loss, theft, leakage, provision to a third party without consent, or falsification of the user’s personal information, including credit card and bank account details.
⑧ The "Mall" or a third party that has received personal information from the "Mall" shall destroy the personal information without delay once the purpose of collection or provision has been achieved.
⑨ The "Mall" shall not set the consent checkbox for the collection, use, or provision of personal information as "pre-selected." Furthermore, it must specify the services that will be restricted if a user refuses to consent to the collection, use, or provision of personal information, and shall not restrict or refuse the provision of services, such as membership registration, on the grounds of a user's refusal to consent to the collection of non-essential personal information.
Article 22 (Attribution of Copyright and Restrictions on Use)
① The copyright and other intellectual property rights for works created by the "Mall" shall belong to the "Mall."
② Users shall not, without the prior consent of the "Mall," reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes or allow a third party to use any information obtained through the "Mall" for which the intellectual property rights belong to the "Mall."
③ If the "Mall" uses the copyright belonging to a user in accordance with an agreement, it shall notify the relevant user.
Article 23 (Dispute Resolution)
① The "Mall" shall install and operate a damage compensation processing organization to reflect reasonable opinions or complaints raised by users and to process compensation for such damages.
② The "Mall" shall prioritize the processing of complaints and opinions submitted by users. However, if prompt processing is difficult, the "Mall" shall immediately notify the user of the reason and the processing schedule.
③ In the event of an electronic commerce dispute between the "Mall" and a user, the "Mall" may comply with the mediation by the Fair Trade Commission or a dispute mediation agency commissioned by a municipal governor.
Article 24 (Jurisdiction and Governing Law)
① Any lawsuit regarding an electronic commerce dispute between the "Mall" and a user shall be subject to the exclusive jurisdiction of the local court having jurisdiction over the user's address at the time of filing; if the user has no address, it shall be subject to the jurisdiction of the local court having jurisdiction over the user's residence. However, if the user's address or residence is unclear at the time of filing, or if the user is a resident abroad, the lawsuit shall be brought to a court with jurisdiction under the Civil Procedure Act.
② The laws of the Republic of Korea shall apply to electronic commerce lawsuits between the "Mall" and the user.
Addendum
These Terms and Conditions shall be effective from January 9, 2026.
